Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Tamind Chrome Extension and website (collectively, the "Service"), operated by Tamind ("we", "us", or "our"). By installing the extension or accessing the Service, you agree to be bound by these Terms.

If you do not agree, please uninstall the extension and do not use the Service.

1. Eligibility

You must be at least 13 years old to use Tamind. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you confirm you have your parent or guardian's permission.

2. Your Account

• Authentication: Tamind uses Google OAuth exclusively. You are responsible for maintaining the security of your Google account.
• One account per user: Creating multiple accounts to circumvent free tier limits is prohibited.
• Account accuracy: The profile information (name, email, avatar) synced from Google must be your own.
• Account termination: We reserve the right to suspend or terminate accounts that violate these Terms.

3. Free Tier & Paid Plans

3.1 Free Plan

New accounts receive 10 free AI generations. Free tier usage is subject to standard Gemini model availability and standard processing priority.

3.2 Pro Plan

The Pro plan provides 300 generations per month, access to a faster and higher-quality AI model, priority processing, full history archive, and HD podcast audio. Billed at $9/month or $7/month when billed annually.

3.3 Pro Plus Plan

The Pro Plus plan provides unlimited generations, the most powerful available AI model, and the fastest response priority, plus all Pro features. Billed at $17/month or $14/month when billed annually.

3.4 Billing & Cancellation

• Payments are processed by Lemon Squeezy. We do not store payment card details.
• Subscriptions renew automatically at the end of each billing period.
• You may cancel your subscription at any time. Access continues until the end of the current billing period, after which your account reverts to the Free plan.
• We do not offer refunds for partial billing periods unless required by applicable law.
• We reserve the right to change pricing with at least 30 days' notice to active subscribers.

4. Acceptable Use

You agree not to:

• Use the Service to generate content that is unlawful, harmful, defamatory, obscene, or that violates any third party's rights
• Attempt to reverse engineer, decompile, or extract the source code of the Service
• Automate requests to the Service in a way that exceeds normal human usage or circumvents rate limits
• Use the Service to process content you do not have the right to use (e.g., copyrighted material scraped without permission)
• Resell, sublicense, or commercialise access to the Service without our written consent
• Attempt to gain unauthorised access to other users' data or any backend systems
• Use the Service to train competing AI models

5. Generated Content

• Ownership: You retain ownership of the content you input. AI-generated outputs are provided to you for your personal use.
• Accuracy: AI-generated content may contain errors, inaccuracies, or hallucinations. Do not rely on generated content for medical, legal, financial, or other professional advice without independent verification.
• Privacy of data: Your generated content is private and only accessible via your authenticated account. We do not view or use your personal generation data.
• Third-party content: You are responsible for ensuring you have the right to extract and process content from any webpage you use with the Service.

6. Intellectual Property

The Tamind name, logo, extension code, website design, and all related intellectual property are owned by Tamind and protected by applicable laws. Nothing in these Terms grants you any rights to our intellectual property beyond the limited licence to use the Service as intended.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated results will be accurate or suitable for any particular purpose.

8. Limitation of Liability

To the fullest extent permitted by law, Tamind shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service — including but not limited to loss of data, loss of profit, or damages resulting from reliance on AI-generated content.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you have paid us in the 3 months preceding the claim, or $10 USD, whichever is greater.

9. Service Availability & Changes

• We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.
• Features may be added, changed, or removed over time.
• We are not liable for any interruption of service due to maintenance, outages, or circumstances beyond our reasonable control.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Continued use of the Service after any changes constitutes your acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through good-faith negotiation first. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of the governing territory.
